I beg to forward the attached depositions of a Magisterial Enquiry held by Edward Boyce JP touching the death of one Edmund Apps

page 4 At a Magisterial inquiry held before one Edwd Boyce Jp this 16th day of November 1880 at Spring Hill Creswick to inquire into the cause of death of Edmund Apps aged 2 days.
Margaret Delana on her oath sayeth I am the wife of Thomas Delana, Hotel Keeper, Spring Gully - on Saturday Nov 13th Mrs Lewis came to my place and asked me to come and see her daughter who was ill - I accompanied her home and found her daughter Mary Ann Apps ill in bed. She expressed a wish to get up and did so and went outside. When she came in again in about five minutes she went to bed and complained of pains. I held her in the bed and in a short time she was delivered of a baby. I attended to the mother first and then to the baby, tying the cord and washing and dressing it - It was a very weakly child.
On Sunday morning I called to see how the child was getting on and found that Mrs Lewis had washed and dressed it and fed it with milk sugar and water - it seemed to be very weak - On Monday about five o'clock Mrs Lewis called to tell me the baby was very ill. I came across and saw it. It was then nearly dead. I sent Mr Lewis for the Doctor. The baby died as near as I can tell between seven and eight o'clock before the doctor had seen it.

page 5 Harriet Lewis on her oath sayeth I am the wife of Henry Lewis Miner residing at Spring Gully Creswick.
My daughter Mary Ann Apps came home on Octr 8th and complained of a cold. She told me she was in the family way and that she expected to be confined in December. She attended the Hospital as an out door patient and took what the Doctor prescribed for her.
On Saturday the 13th about half past one she complained of pains in her stomach and asked me to give her some salts. I did so and then went for Mrs Dilane who came back with me. She was in bed when we came in and expressed a wish to get up. She did so and went outside. She returned in about five minutes and again went to bed. She was then sevsid? with pains and in a short time a baby was born. Mrs Dilaine attended to the baby and washed and dressed it - after Mrs Dilane left I attended to the mother and baby. It was a very weak child and it was with great difficulty I could get it to take food.
On Monday afternoon I noticed a change in the child - its face got dark and it had a short cough. I sent my Husband to go for the Doctor but the child died shortly afterwards.
We had no Doctor to confine the mother as we did not expect it would take place so soon. The child Edmund Apps was the illegitimate child of my Daughter Mary Ann Apps.

page 6 This Deponent. Robert Charles Lindsay on his oath saith as follows. I am a legally qualified medical practioner residing at Creswick. I have this day made a post mortem examination of the body of male infant, apparently about two days old, the child of Mary Ann Apps residing at Spring Gully. There were no marks of external violence on the body which appeared in an unhealthy and emaciated condition. There was no appearance of disease in the internal organs. I am of the opinion that deceased died from debility owing to a generally ill conditioned state of its constitution and an inability to take a sufficiency of nourishment to sustain life.

page 7 From the evidence taken by me at a magisterial inquiry held at Spring Gully - Creswick this 16th day of November 1880 I find that the cause of death of Edmund Apps aged 2 days was debility and want of sufficient strength to take proper nourishment.
