James HOCKEY [CON 31/20] was committed for trial on 28 May 1829 and was lodged in Shepton Gaol, tried at Bridgwater Assizes, found guilty of stealing a gelding, sentenced 22 Aug 1829 to death, commuted to 14 yrs transportation, 27 Aug 1829 transferred to Ilchester County Gaol, 29 Sep 1829 transferred to Captivity Prison Hulk, Devonport, arrived Van Dieman's Land on the Sir Charles Forbes 26 Jul 1830.
Indictments for the Summer Assizes at Somerset 1829 [Ref ASSI 25/21/10]
James HOCKEY was charged with Cornelius LOXTON on a charge of stealing one saddle worth twenty shillings and one bridle worth five shillings belonging to William HYATT of Shepton Mallet Somerset on 4 May 1829. However, they were not tried on this charge, but were both convicted on another indictment, of stealing a gelding worth twenty pounds belong to Henry HODGES at Doulting Somerset on 13 May 1829. They both pleaded not guilty but were convicted and sentenced to be hanged, a sentence which was commuted to transportation. Both men had previous convictions. They had been found guilty of felony at the Quarter Sessions at the Castle of Taunton on 15 Oct 1827. [Letter from PRO London to Laurel Merritt 14 Feb 1986]
Somerset County Gaol Record Book
James HOCKEY was committed for trial on 28 May 1829 on a charge of stealing a gelding and was lodged in Shepton Gaol until August. On 22 Aug he appeared at the Bridgwater Assizes, was found guilty and sentenced to death, commuted to 14 years transportation. On 27 Aug 1829 James HOCKEY was transferred to the County Gaol at Ilchester and transferred on 29 Sep 1829 to the Captivity Prison Hulk, Devonport, near Plymouth.
Gaol Book description for James HOCKEY recorded the following details: aged 20 (21 in record of sentence) 5' 5" tall, slender, pale, round visage, brown hair, grey eyes, mole on left cheek, Butcher, born and living at Shepton, married with 2 children, able to read and write.
