On 12 Apr 1837 James HOCKEY was granted a Ticket of Leave, at that time working for Mr ED Wedge at Snakebanks. James applied for but was refused permission to have his wife and children sent out from England to the Colony. [Colonial Secretary's Office Files CSO 1/Vol 377/file 3578 page 183]

On 12 Dec 1838 James HOCKEY applied to marry Ann BAREFOOT, aged 18, Free.

Vagrancy
James Hockey, of Kyneton, was brought up by detective Tuckwell, charged under the Vagrant act with being the occupier of a house frequented by reputed and convicted thieves and vagabonds. The prisoner pleaded not guilty. He was defended by Mr Payne and Detective Tuckwell conducted the prosecution.
In answer to the Bench Mr Payn said that he had no evidence to call for the defence, but he was fully convinced that there was no evidence to convict. He would not press his defence further if the Bench had made up their mind to convict the prisoner.
The Prisoner - Your worhips I cannot be held accountable for what is done at my house in my absence, when I am at work on my farm, Mr Kenworthy has himself stated that the misconduct complained of was not mine.
The Bench then sentenced the prisoner to 12 months imprisonment in Melbourne gaol, with hard labor.
Mr Payn said there was an appeal under the Act.
The Bench - You can appeal by making application to the Supreme Court, but the prisoner will in the meantime be sent to gaol.
